Often times, a win at trial or on summary judgment means having won only the battle, not the war. The same is true of a defeat at trial or upon certain motions that must be appealed immediately – we may be down, but we’re not out. An appeal by one side or the other is sure to follow. We have a proven track record of defending our good results on appeal, and overturning those which did not go our client’s way in the lower court. We’re not perfect in this area.
